Terms of service

These terms govern your use of Helvadata, a Swiss nLPD compliance service accessible at helvadata.ch. By creating an account or using the service you agree to these terms. If you do not agree, do not use the service. We keep these terms short and in plain language on purpose.

1. The service

Helvadata provides software that helps Swiss small and medium-sized enterprises document and maintain their data-protection obligations under the Swiss revised Data Protection Act (revDSG) and the EU General Data Protection Regulation (GDPR). The service is not legal advice and does not substitute professional legal counsel for complex matters.

2. Your account

  • You must be at least 18 years old and legally able to enter a contract.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for the accuracy of the information you enter into Helvadata, including the RoPA interview.
  • One account per person. You may represent an organisation; that organisation also agrees to these terms.

3. Your content and data ownership

You own all data you enter into Helvadata — your organisation profile, your RoPA entries, your breach records, your processor contracts. We store and process this data solely to provide the service. You can export your data at any time and delete your account at any time; details are in our privacy notice. We do not sell or rent your data, ever.

4. Acceptable use

  • Do not use Helvadata to process unlawfully obtained personal data.
  • Do not attempt to breach the security of the platform or other users' data.
  • Do not abuse the AI generation feature (for example by submitting harmful or malicious prompts).
  • Do not resell, white-label, or sub-license Helvadata without a separate partnership agreement.

5. Availability and discovery phase

Helvadata is currently in a discovery phase. We provide the service on a best-effort basis, with no formal uptime guarantee. We aim for 99% availability outside of scheduled maintenance. For the duration of the discovery phase, the service is provided at no charge or at a discovery-phase discount. We will give you at least 30 days' written notice before any pricing change that affects your subscription.

6. Pricing and payment

  • Discovery phase: free or at the 50% discovery-phase discount described on the landing page.
  • Standard pricing tiers (Starter CHF 149/month, Business CHF 299/month, Fiduciary on request) apply once the discovery phase ends.
  • All prices exclude Swiss VAT (8.1%). Invoicing is available on request.
  • You may cancel at any time, effective at the end of the current billing period. Pre-paid annual subscriptions are non-refundable except as required by law.

7. Intellectual property

Helvadata, the software, the interface, the templates, and the branding are our property. You receive a limited, non-transferable license to use the service while your subscription is active. You may use the output of the service — including generated RoPA documents — freely within your organisation and for any regulatory submission.

8. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate accounts that violate these terms, with notice where practical. Upon termination we delete your data within 30 days, except where we are legally required to retain it. You can export all of your data before termination.

9. Limitation of liability

To the fullest extent permitted by Swiss law, Helvadata's total liability for any claim arising from or related to the service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits or data. This limitation does not apply to liability for intentional misconduct or gross negligence.

10. Governing law and jurisdiction

These terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Zurich, Switzerland.

11. Changes to these terms

We may update these terms. For material changes, we will notify you at least 30 days in advance by email and by banner inside the service. Continued use of the service after the effective date means you accept the updated terms.
